Terms
1. In this Agreement, the following Terms were discussed:
Shared Areas
2. The rooms in the Property that the Landlord has agreed the Lodger can share with them and any other occupants of the Property.
Property
3. _________, England, along with any fixtures and accessories.
Rent
4. The rent is £_________ paid monthly in advance. The first payment will be paid on the effective date and the subsequent payments will be paid on the same day each month thereafter. Should the Lodger fail to pay the rent the Landlord may serve upon them a notice for payment and/or removal or apply to court for payment and/or removal.
Room
5. The room at the Property, as agreed upon by the Landlord for rental by the Lodger.
Services
6. The Landlord does not include any services to the Lodger apart from the Room itself.
Effective Period
7. The Lodger Agreement will start on _________ ("The Start Date").
8. The Lodger Agreement will end on _________ ("The End Date").
9. Any co-tenants designated as Lodgers under this agreement shall be subject to joint and several liability for their obligations to the Landlord.
10. The 'Landlord' includes successors in title.
11. This Agreement covers the rental of a room in a private furnished residence, including any associated Inventory and Services (if any).
12. The Landlord hereby grants, and the Lodger accepts, a licence to occupy the Room located at the Property for the Effective Period of this Agreement. This licence is contingent upon the payment of Rent and allows the Lodger to utilise the designated Shared Areas as outlined within the Agreement.
13. The Lodger recognizes this as an excluded licence under the Protection from Eviction Act 1977, which means the Lodger does not have the same eviction rights as an ordinary tenancy because you share the property with the Landlord.
14. The Lodger acknowledges this Agreement does not constitute an assured or assured shorthold tenancy, nor an occupation contract as it is a letting granted by a resident landlord.
15. The Agreement applies only to the Lodger.
16. The Room is considered part of the Property.
17. The Landlord gives the Lodger the right to access and use the Shared Areas of the property, along with any other residents.
18. The Lodger will:
a. keeping the furniture in good condition: This includes avoiding damage, breakage, removal from the property, and ensuring it remains clean; and
b. making good any damage or breakage that occurs during the tenancy.
19. To pay the rent and all other sums outlined in this Agreement on time and in full.
20. To pay rent or other charged interest in the case is overdue. The interest rate will be 3% above the Bank of England's base rate, calculated from the due date until the day we receive the full payment.
21. To pay a fair contribution (based on usage) towards the costs of utilities like gas, electricity, oil, water, sewage, telephone (including line rental), and any other services used at the property.
22. To maintain the cleanliness and good condition of their room, avoiding causing any damage to the property or its fixtures and accessories.
23. To use the Room solely for residential purposes and not carry on any trade, profession or business on or from the Property.
24. Not to keep any pets at the Property.
25. To be respectful of other occupants in the property and avoid creating disturbances for neighbors.
26. To avoid any illegal or immoral activity in the Room.
27. To obtain written permission from the Landlord before making any changes to the decoration of the room or the property.
28. To inform the Landlord promptly about any repairs or problems with the Property that the Landlord is responsible for fixing.
29. To grant the Landlord access to the room at reasonable times for inspections or repairs with reasonable notice given in advance.
30. The Landlord retains access to all areas of the Property, except the Lodger's Room without previous notice.
31. On leaving the Property, the Lodge must:
a. provide a forwarding address to the Landlord.
b. remove all personal belongings, including furniture and equipment, from the Property. This also includes disposing of any rubbish.
c. return all the keys to the Property to the Landlord.
32. The Lodger does not have the right to completely exclude the Landlord from the Room.
33. The Landlord agrees to provide the Services to the Lodger and provide a copy of the property's insurance policy upon request.
34. The Landlord will pay the council tax in respect of the Property.
35. The Deposit (if any) is to be held in an account by the Landlord for the Effective Period as security to ensure fulfillment of Agreement terms and cover possible unpaid rent/charges by the Lodger.
The Deposit will be returned to the Lodger less unpaid charges /cleaning /damage repairs (minus fair wear & tear), remaining deposit returned upon tenancy end.
36. If the Property becomes uninhabitable due to damage, the Lodger can suspend rent payments until repairs are complete and the Property is habitable again, unless:
a. the Lodger caused the damage or failed to take actions that voided the Landlord's insurance.
b. the Landlord previously informed them about specific actions required to maintain insurance coverage.
37. The Landlord agrees to mantain the property in a habitable condition.
38. This Agreement terminates after the Effective Period or upon the occurrence of an event as stipulated in the clauses below.
39. If the Lodger breaches any of their obligations, the Landlord may terminate this Agreement early. The required notice period for a weekly rent is at least one week's written notice; and for a monthly rent at least one month's written notice.
40. If this Agreement terminates in accordance with this clause:
a. the Lodger won't owe rent or any other fees for the days after the agreement ends.
b. on the date on which this Agreement terminates, will refund you any rent or other fees you already paid for the days after the agreement ends, calculated based on the daily rate.
41. Terminating this Agreement under this clause will completely end it, with neither party owing anything to the other in the future, applying only if there exist breaches of the Agreement.
Governing Law and Jurisdiction
42. This Agreement shall be governed, construed and interpreted by the laws of England and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English courts.
